Terms and Conditions
These terms cover your use of vamicode.com and anything you buy from us through it. We have tried to write them in plain language rather than legal boilerplate, but they are still the agreement between us, so they are worth reading before you order.
The short version: buy a licence, use it on the number of sites your plan allows, send only email that people asked for, and tell us within seven days if you want your money back.
Who we are
This site is operated by Vamicode AI Labs, Koirauna, Kalika Nagar, Sant Ravidas Nagar, Bhadohi – 221309, Uttar Pradesh, India. You can reach us at info@vamicode.com.
Where these terms say “we”, “us” or “our”, they mean Vamicode AI Labs. Where they say “you”, they mean the person or organisation using the site or buying from it. If you are agreeing on behalf of a company, you are confirming you are allowed to do that.
Agreeing to these terms
By browsing the site, placing an order, or using anything you buy from us, you accept these terms. If you do not accept them, please do not use the site or buy from it.
What we sell
We sell two different things, and they work differently:
- Software licences. Downloadable WordPress plugins, licensed per site, sold with a period of updates and support.
- Development and consultancy services. Work agreed separately in writing, such as a proposal, statement of work, or signed quote.
These terms govern the software licences and general use of the site. Where we have signed a separate agreement with you for services, that agreement governs the services, and it takes precedence over these terms if the two ever conflict.
Orders, prices and payment
Prices are shown in US dollars (USD). Any tax that applies is calculated and shown at checkout before you pay.
Payment is taken at the time of purchase through our payment provider. We do not receive or store your full card details; the provider handles them, and we only see the result of the transaction and the billing details you give us.
An order is not accepted until payment clears and we send your confirmation. If something is listed at the wrong price or described incorrectly because of an obvious error, we may cancel the order and refund you in full rather than honour the mistake, and we will tell you why.
We may change our prices at any time. A change never affects an order you have already paid for.
Delivery
Everything we sell through this site is digital. There is nothing to ship. We email your licence key and download link to the address on your order once your order is confirmed, usually within one business day.
If it has not arrived within one business day, check your spam folder first, then email us at info@vamicode.com and we will send it straight over.
Your licence
Our plugins are released under the GNU General Public License v2 or later, and nothing in these terms takes away the rights that licence gives you over the plugin code.
What you buy from us is a commercial licence that entitles you to:
- use the software on the number of sites your plan covers;
- receive updates for the period your plan covers; and
- receive support from us for that same period.
The number of sites, the length of the term, and what support includes are set out on the product page for the plan you buy.
When a licence expires. The plugin keeps working and your data stays where it is. What stops is updates and support, and any features restricted to a paid plan return to the free plan’s limits until you renew.
Moving a licence. You may deactivate a licence on one site and activate it on another from your account. You may not share a licence key with anyone outside your organisation, resell it, or use one licence to cover more sites than your plan allows.
Using our email software responsibly
This one matters. Our sending software routes mail through an SMTP account that you control, which means you, not us, are the sender of everything it sends. By using it you agree that:
- everyone on your list has given you permission to email them;
- you will honour unsubscribe requests promptly, and will not remove or disable the unsubscribe link the software includes;
- your messages identify you accurately and are not deceptive; and
- you will comply with the anti-spam and data protection laws that apply to you and to the people you are emailing, which may include the GDPR, the CAN-SPAM Act, CASL, and India’s applicable rules.
We do not monitor what you send and we cannot send on your behalf. If your sending gets your domain blocklisted, your SMTP account suspended, or you in trouble with a regulator, that is your responsibility, not ours. We may terminate a licence without refund if we find it is being used to send unsolicited bulk email.
Acceptable use of this site
Please do not attempt to break into the site, disrupt it, scrape it at a volume that degrades it for others, upload malicious code, or use it to do anything unlawful. We may suspend access if you do.
Accounts
If you create an account, keep your password to yourself and tell us promptly if you think someone else has it. You are responsible for what happens under your account. Please keep your email address current, because that is where licence keys, receipts and update notices go.
Refunds
We offer a 7-day money-back guarantee on paid plans. If the software is not right for you, email info@vamicode.com within seven days of your purchase and we will refund you. You do not have to justify the request.
After seven days we do not generally refund, because the software has been delivered and cannot be returned. We will still look at genuine cases individually, particularly where something is broken and we cannot fix it.
Refunds go back to the payment method you used. When a refund is issued, the licence stops being valid and you should remove the software from your sites.
None of this limits any rights you have under consumer law that cannot be excluded by agreement.
Our Refund and Returns Policy sets out the process in more detail.
Third-party services
Our software is designed to work with services you supply and control, such as your SMTP provider. We are not responsible for those services, their pricing, their availability, or what they do with the data you route through them. Your relationship with them is governed by their terms, not ours.
The same applies to our payment provider, and to any third-party plugin or theme you run alongside our software.
Support and updates
We provide support by email at info@vamicode.com to customers with an active plan. We aim to reply within two business days, though that is a goal rather than a contractual commitment.
Support covers our software. It does not extend to fixing your server, configuring your SMTP provider, debugging unrelated plugins, or building custom features, though we are happy to quote separately for work of that kind.
We may change, improve or discontinue features. If we ever discontinue a product outright, we will give reasonable notice to customers with an active plan.
Intellectual property
The Vamicode AI Labs name, logo, site design, written content and images are ours and are protected by copyright and trade mark law. Buying a licence does not give you the right to use our branding as your own.
The plugin source code is separately licensed under the GPL, as described above.
Availability
We try to keep this site and our licence services available, but we do not promise uninterrupted access. Maintenance, hosting problems, and things outside our control all happen. We are not liable for losses caused by the site being temporarily unavailable.
Disclaimers
Our software is provided “as is”. While we work hard to make it reliable, we do not warrant that it will be error-free, that it will work with every combination of plugins, themes, hosts and PHP versions, or that it will achieve any particular deliverability or open rate. Email deliverability depends on your domain reputation, your list, your content and your SMTP provider, all of which are yours.
Always keep a backup of your site before installing or updating any plugin, including ours.
Limitation of liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost revenue, lost data, or loss of goodwill arising from your use of the site or our software.
Where we are liable, our total liability to you is limited to the amount you paid us in the twelve months before the claim arose.
Nothing here excludes liability that cannot lawfully be excluded, such as liability for fraud.
Your indemnity to us
If someone brings a claim against us because of email you sent using our software, or because you broke these terms or the law, you agree to cover the reasonable costs we incur defending it.
Suspension and termination
We may suspend or terminate your licence or account if you materially breach these terms, and we will tell you why. You can stop using our software at any time; where a refund is not due, ending your use early does not entitle you to money back.
Privacy
How we handle personal information is set out in our Privacy Policy, which forms part of these terms.
Changes to these terms
We may update these terms as our products change or the law does. When we do, we will update this page and change the date at the top. The version published here when you place an order is the version that applies to that order.
Governing law
These terms are governed by the laws of India, and the courts of Uttar Pradesh, India will have jurisdiction over any dispute, except where consumer protection law in your own country gives you the right to bring a claim locally.
Before anything formal, please just email us. Most things are quicker to sort out that way.
